Roundup is one of the most commonly used weed killers in the United States. For decades Roundup has been marketed as a safe and effective product for household and commercial use. Yet more than a dozen scientific studies dating back to the 1970s have shown that Glyphosate, the active ingredient in Roundup, causes cancer in humans, specifically Non-Hodgkin’s Lymphoma.
Despite the fact that study after study has consistently shown a link between Glyphosate and cancer, Roundup has been sold by Monsanto for both commercial and home use for decades without any warning that its users may be at risk for developing cancer. Monsanto was acquired by Bayer in 2018, and even today. Bayer continues to sell Roundup without warning consumers of the cancer risk.
Roundup According to Science
Scientists have been studying the cancer-causing effects of Glyphosate since the early 1970s.
Many of the scientists who have studied Glyphosate were hired by Monsanto to do so. One such scientist, Dr. James Parry, was actually hired by Monsanto to be a spokesperson for Roundup. Dr. Parry didn’t reach the conclusion about Roundup that Monsanto had hoped he would, however, and instead issued multiple reports advising Monsanto that Roundup might cause cancer and recommending that Monsanto perform additional testing. Monsanto now admits it did not perform the additional tests recommended by Dr. Parry and in fact withheld his reports from the Environmental Protection Agency (EPA) when seeking approval to market Roundup to unsuspecting Americans.
Recently, the International Agency for Research on Cancer (IARC), which is part of the World Health Organization (WHO), reviewed the body of available scientific research regarding Glyphosate, concluded that Glyphosate is probably carcinogenic to humans, and classified Glyphosate as a Class 2A carcinogen.
Roundup According to Juries
More than 13,000 lawsuits have been filed against Monsanto by people who claim they developed Non-Hodgkin’s Lymphoma as a result of using Roundup. Three of these lawsuits have gone to trial, and in each case, the jury has found that not only did Monsanto negligently fail to warn consumers of the risks associated with Roundup but also that Monsanto engaged in conduct that was so egregious as to warrant the imposition of punitive damages.
In the Hardeman trial, a jury awarded the Plaintiff approximately $5 million in compensatory damages and an additional $75 million in punitive damages. In the Johnson trial, a different jury awarded the Plaintiff approximately $39 million in compensatory damages and an additional $250 million in punitive damages.
Finally, in the Pilliod trial, which involved the claims of a husband and wife who sprayed Roundup together and who both developed Non-Hodgkin’s Lymphoma, the jury awarded approximately $55 million in compensatory damages and an additional $2 billion in punitive damages. Because most states limit the amount of punitive damages that can be awarded, these verdicts are all likely to be reduced on appeal. The magnitude of the punitive damages awarded by three different juries, in three different courtrooms, after hearing all of the evidence, provides a clear message to Monsanto that its callous decision to prioritize profits over the health and safety of the millions of Americans who used Roundup thinking it was safe will not be tolerated.
